Affidavit of Death
An affidavit of death can be filed in two situations following the death of a loved one. If an affidavit is being filed for a deceased spouse, the property must be held by both spouses jointly. In this case, the affidavit will remove the deceased spouse and leave the surviving spouse as the sole owner. This transaction must be done at the time of a spouses death to properly remove them from the property title.
