Affidavit of Death - $129*
An affidavit of death can be filed in two situations following the death of a loved one. If an affidavit is being filed for a deceased spouse, the property must be held by both spouses jointly. In this case, the affidavit will remove the deceased spouse and leave the surviving spouse as the sole owner. This transaction must be done at the time of a spouses death to properly remove them from the property title.
Another situation where an affidavit of death must be used is at the time of death of a person who held property in a living trust. The affidavit of death will be done for the trustee and will again, remove the decedent from the property.
We can prepare the appropriate affidavit for you as well as take care of the filing with the county. Please be aware that you must have an original death certificate to accompany the affidavit.
